By accessing our website, placing an order, or using any of our services, you (“you”, “customer”) agree to be bound by these Terms of Service. If you do not agree with these Terms, please refrain from using our website and services. We may update these Terms from time to time; the version in force at the time of your order applies to that order.

2. Eligibility

You must be at least 18 years old, or have the consent of a parent or legal guardian, to use this website and place orders. By using our website, you confirm that you have the legal capacity to enter into legally binding agreements and that all information you provide is accurate and complete.

3. Products and Availability

We strive to ensure that all product descriptions, specifications, measurements, pricing, and images are accurate and up to date. However:

• Product colours may vary depending on monitor settings and device displays.
• Measurements may vary slightly due to manufacturing tolerances.
• Product availability is subject to stock levels.
• We reserve the right to modify, update, or discontinue products at any time.

We do not guarantee that products displayed on the website will always be available. We are not bound by obvious errors or typographical mistakes in product descriptions or pricing.

4. Pricing and Payment

All prices are shown in the currency selected at checkout. Unless otherwise stated, prices do not include import duties, customs charges, VAT, local taxes, brokerage fees, or other governmental charges imposed by the destination country.

Accepted payment methods are those displayed at checkout, including major credit cards, debit cards, PayPal, and other available payment providers. All payments are subject to verification and fraud-prevention procedures. We reserve the right to refuse or cancel any order where fraud, unauthorised activity, or violation of these Terms is reasonably suspected.

5. Order Acceptance

Submitting an order does not constitute acceptance of that order. An order is considered accepted only after:

• Payment has been successfully authorised and received; and
• A shipment confirmation email has been sent to you.

We reserve the right to refuse, limit, or cancel orders due to product unavailability, pricing or inventory errors, suspected fraud, or violation of these Terms. If payment has already been collected, a full refund will be issued for any cancelled order.

6. Shipping and Delivery

Pallecarte ships worldwide from Georgia through UPS and other approved logistics partners where necessary.

Order Processing. Orders are typically processed within 1–3 business days. During collection launches, seasonal sales, holidays, or periods of increased demand, processing times may be extended.

Estimated Delivery Times (from dispatch, for guidance only — not guaranteed):

• Europe: 3–7 business days
• United Kingdom: 4–8 business days
• United States & Canada: 5–10 business days
• Middle East: 4–8 business days
• Asia Pacific: 5–12 business days
• Rest of World: 5–14 business days

Customs Duties and Import Taxes. International shipments may be subject to customs duties, VAT, import taxes, brokerage fees, and other charges imposed by local authorities. These charges are the sole responsibility of the recipient unless otherwise stated at checkout.

Customs Delays. Pallecarte is not responsible for delays caused by customs inspections, clearance procedures, governmental actions, weather, transportation disruptions, or other circumstances beyond our reasonable control.

Incorrect Shipping Information. You are responsible for providing complete and accurate shipping information. If a shipment is returned due to incorrect address details, refusal of delivery, failure to pay customs duties or taxes, or multiple unsuccessful delivery attempts, Pallecarte reserves the right to deduct any additional shipping costs, customs charges, return fees, or handling expenses from the refund amount.

Risk of Loss. Risk of loss and title to products pass to you upon delivery to the shipping address provided in the order.

7. Right of Withdrawal (EU / UK Consumers)

If you are a consumer in the European Union or the United Kingdom, you have the right to withdraw from your purchase within 14 days of receiving the goods, without giving any reason. To exercise this right, notify us at pallecarte37@gmail.com within 14 days by a clear statement. You must return the goods within 14 days of notifying us. You are responsible for the direct cost of return shipping. We will reimburse all payments received, including standard delivery costs, within 14 days of receiving the returned goods or proof of return, using the same payment method you used.

You may handle and inspect the goods only as you would in a shop. You are liable for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics, and functioning.

This right does not apply to certain goods, including items sealed for health or hygiene reasons whose seal has been broken (e.g. underwear, socks), or goods made to your specifications or clearly personalised.

8. Returns

In addition to (and separately from) the statutory right above, customers may request a return within 14 calendar days of receiving their order. Returned items must be:

• Unused and unworn;
• Unwashed;
• In their original condition;
• Returned with all original garment tags attached;
• Returned with all original packaging.

Returns that are damaged, altered, soiled, or show signs of use may be refused. For hygiene reasons, underwear, socks, and similar products may only be returned if their original packaging remains unopened and undamaged.

9. Refunds

Once returned items are received and inspected, approved refunds are issued to the original payment method, generally within 5–10 business days following inspection and approval. Original shipping fees, customs duties, import taxes, brokerage fees, and return shipping costs are non-refundable unless required by applicable law.

10. Exchanges

Exchange requests are subject to stock availability. Contact pallecarte37@gmail.com first. Once an exchange is approved, Pallecarte covers the shipping cost of the replacement item. You remain responsible for the cost of returning the original item unless the exchange results from a defective, damaged, or incorrectly supplied product.

11. Acceptable Use

You agree not to use the website for any unlawful purpose, to attempt to gain unauthorised access to our systems, to interfere with the website’s operation, or to use automated means to scrape or copy content without our permission.

12. Intellectual Property

All content on this website — including the Pallecarte name, logo, designs, product imagery, text, and graphics — is owned by or licensed to Pallecarte and is protected by intellectual property laws. You may not copy, reproduce, distribute, or use any content for commercial purposes without our prior written consent.

13. Privacy

Personal information you provide is processed in accordance with our Privacy Policy, available on the website. By placing an order, you consent to such processing.

14. Limitation of Liability

To the maximum extent permitted by law, Pallecarte excludes all liability for any indirect or consequential damages, and for any damages arising where an ordered product is unavailable or not delivered on time. To the maximum extent permitted by law, our total liability in connection with any product is limited to the purchase price of that product. Nothing in these Terms limits liability that cannot be excluded under applicable law, including statutory consumer rights.

15. Force Majeure

Pallecarte is not liable for any failure or delay in performance caused by events beyond our reasonable control, including strikes, breakdowns, illness, supply disruptions, customs or governmental actions, natural disasters, or import/export restrictions. If such an event continues for more than two months, either party may terminate the affected order without liability for damages.

16. Governing Law and Disputes

These Terms are governed by the laws of Georgia. Any disputes arising from these Terms or your use of the website shall be submitted to the competent courts of Tbilisi, Georgia. If you are a consumer resident in the EU or UK, this does not deprive you of the protection of mandatory consumer-protection provisions of your country of residence, and you may also use the EU Online Dispute Resolution platform where applicable.
